Chipfancier (“the Seller”) warrants to the original end-user purchaser (“you”) that, during the warranty period listed below, the product (excluding any third-party software) will be free from material and workmanship defects under normal use. This warranty only covers defects that occur under normal use and does not include failures or malfunctions caused by misuse, abuse, negligence, alteration, power problems, non-compliance with the product instructions, natural causes, or improper installation or repair by a third party not authorized by the Seller or the Seller.

You may be required to provide proof of purchase to obtain warranty service authorization from the Seller, including a Return Material Authorization (RMA) number within the applicable warranty period, and then return the defective product to the Seller. All returns are subject to the standard RMA terms and conditions defined by the Seller in this document. Returned products must be prepaid for shipping and properly packaged, and it is recommended to insure them or ship them with package tracking. The Seller is not responsible for products lost or damaged during shipping.

Your sole remedy and the Seller's entire liability under this warranty will be for the Seller to repair, replace, or refund the product determined to be defective within the applicable warranty period at its own option. The replacement will be a similar product at the Seller's discretion. The refund will be the purchase price minus any rebates or fair market value, whichever is lower. The Seller does not warrant that no data or images will be lost (including data stored on products returned to the Seller for repair), and the Seller is not responsible for such losses.

All implied warranties or conditions of merchantability, satisfactory quality, or fitness for a particular purpose are limited to the duration of the applicable express warranty. All other express or implied conditions, representations, and warranties, including any implied warranty of non-infringement, are disclaimed to the fullest extent permitted by law.

The Seller cannot and does not warrant that your data will not be accessed by unauthorized persons, and the Seller disclaims any warranty to that effect to the fullest extent permitted by law. Some jurisdictions do not allow limitations on the duration of implied warranties or do not allow limitations at all, so the above limitations may not apply to you. This limited warranty gives you specific legal rights, and you may have other rights that vary by jurisdiction. This limitation does not affect your legal rights.

All third-party software provided through the Seller is provided “as is”. You assume the full risk regarding the quality, performance, accuracy, and effect of such software, and if it is found to be defective, you, not the Seller, will be responsible for all necessary repairs or corrections at your expense.

To the fullest extent permitted by law, the Seller is not liable under any circumstances for any lost images, data, income, or profits, or for special, indirect, consequential, incidental, or punitive damages, regardless of how they are caused, regardless of the theory of liability, arising from the use or inability to use the product, even if the Seller has been advised of the possibility of such damages. In any case, the Seller's liability shall not exceed the amount you paid for the product.

Even if any warranty or remedy provided under this agreement fails of its essential purpose, the above limitations will apply. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.
